1. Agreement To Terms

By purchasing LeadTide services, checking the agreement box at checkout, or using leadtide.ai, you agree to these Terms & Conditions. If you don't agree, please don't use our website or services.

2. What We Offer

The LeadTide System — $1,997 to build, then $247/month. A 24/7 AI receptionist that answers calls and texts and books appointments, automated follow-up and lead revival, appointment reminders and confirmations, review request automation, a conversion-focused website with AI chat, hosting, unlimited edits, and monthly reporting.

Website Only — $1,397 to build, then $97/month. A conversion-focused website built for your trade, AI chat widget, hosting, SSL, uptime monitoring, and unlimited content edits.

Upgrading. You may upgrade from Website Only to the full System at any time by paying the $600 difference in build price. No rebuild is required. Your monthly rate moves to $247 beginning with your next billing cycle.

3. Pricing & Payment

Your build fee is due in full at purchase. Monthly service begins 30 days after your purchase date and recurs monthly thereafter.

Payments are processed through Stripe. By purchasing, you authorize recurring charges to your payment method until you cancel. If a payment fails, we will attempt to collect again and may suspend service after 10 days of non-payment.

4. Delivery Timeline

After purchase we send you an intake form. Once you return it completed, we deliver your mockup within 24–48 hours. We then revise until you approve the setup. Final delivery is 5–7 days after your approval of the complete setup.

These timelines depend on receiving what we need from you: a completed intake form, accurate service and pricing details, access to the accounts we need to connect, and timely feedback on mockups. Delays on your side extend the timeline accordingly.

5. What We Need From You

To deliver on time, you agree to provide a completed intake form, accurate service descriptions and pricing, access credentials for accounts we need to connect (phone, Google Business Profile, calendar, domain or existing website), timely feedback at each review stage, and a valid business phone number for carrier messaging registration.

6. No Contract & Cancellation

Monthly service is month-to-month with no long-term contract. You may cancel at any time; cancellation takes effect at the end of your current billing period and there are no partial-month refunds.

Build fees are non-refundable once work has begun, except as described in Section 7. On cancellation, your customer data remains yours and we will provide an export on request. Automations, phone routing, and AI agents stop functioning at the end of your paid period.

7. Our Guarantee

If we don't deliver what we promised, tell us and we'll fix it fast. If we still can't make it right within 30 days of you notifying us in writing, you may request a full refund of your build fee.

This guarantee covers our failure to deliver the service described. It does not cover business results, revenue outcomes, or lead volume, which depend on factors outside our control including your market, pricing, capacity, and service quality.

8. Ownership & Your Data

You own your website content, your domain, and your business data. Your customer data belongs to you — we do not sell, rent, or share it, and we access it only as needed to provide and support the service.

LeadTide retains ownership of the underlying technology, software, workflows, templates, and AI infrastructure used to deliver our services. You receive a license to use them for your business for the duration of your subscription.

9. Your Messaging Responsibilities

You are solely responsible for ensuring you have proper consent to contact your customers by text message and email, and for complying with applicable law including the TCPA and CAN-SPAM Act.

You agree not to upload purchased lists, contact individuals who have not consented, or use the system for any unlawful purpose. Violations may result in immediate suspension without refund.

10. AI-Generated Responses

Our AI agents generate responses automatically based on the information they're trained on. While we work to keep them accurate, they may occasionally make mistakes. If an AI agent gives inaccurate information, let us know and we'll correct it promptly.

11. Results Disclaimer

Figures shown on our website, including our revenue-leak calculator, are estimates based on typical industry patterns. They are not guarantees or projections of your results. Your outcomes depend on your market, pricing, capacity, and how you use the system.

12. SMS & Communications Consent

By providing your phone number, you consent to receive service-related text messages from LeadTide. Message and data rates may apply. Reply STOP to opt out at any time, or reply HELP for help.

13. Carrier Liability

Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your wireless carrier and is not guaranteed. We also rely on third-party providers including Google, phone carriers, and payment processors, and are not responsible for their outages, though we will work to restore functionality promptly.

14. Age Restriction

Our SMS program and services are intended only for individuals 18 years of age or older. By opting in or using our services, you represent that you are at least 18 years old.

15. Acceptable Use

You agree not to use our website or services for any unlawful purpose or in any way that could damage, disable, or impair them.

16. Limitation Of Liability

Our services are provided "as is." To the fullest extent permitted by law, LeadTide is not liable for any indirect, incidental, or consequential damages arising from your use of our website or services, including lost profits or lost business opportunities. Our total liability for any claim is limited to the amount you paid us in the twelve months preceding the claim.

17. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law principles.

18. Changes To These Terms

We may update these Terms from time to time. The effective date at the top of this page reflects the most recent update. Material changes will be communicated to active clients by email at least 30 days before taking effect.
